INRUCK General Conditions of Use
These General Conditions of Use govern the relationship between:
The User of the INRUCK Application

The purpose of these General Conditions of Use (hereinafter referred to as "GCU") is to provide a legal framework for the terms and conditions for making the INRUCK Application and the Services available by WIIBUS and the club and to define the conditions of access and use of the Services by the User.

WIIBUS reserves the right to unilaterally modify the content of these T&Cs at any time. The T&Cs on the Application constitute the latest updated version. Users of the INRUCK Application are therefore invited to consult them regularly.

Article 1: Definitions
Application : designates the INRUCK application
Administrator : refers to the contact person on INRUCK for a partner company. In addition to traditional user access, the person can add a partner event and distribute invitations available to the partner company.
User account : means any account opened by a natural or legal person registered on the Application allowing them to have access to the customer/technician area.
General Conditions of Use (or “GCU”) : means these General Conditions of Use of the Application.
Personal data : any information relating to an identified or identifiable natural person (hereinafter referred to as “data subject”); an “identifiable natural person” is deemed to be a natural person who can be identified, directly or indirectly, in accordance with Article 4.1 of the General Data Protection Regulation (GDPR) of April 27, 2016, which came into force on May 25, 2018.

Parts) : designates individually or collectively WIIBUS and a User.
Service(s): means the features available on the Application and accessible by the User. The features of the Application are as follows:
- Posting messages and photos;
- Like and comment on posts;
- Access to information from the club's partner companies;
- Access to contacts of the club's partner companies;
- Access to club results and rankings
- Access to the club's events calendar, including home matches
- Registration for club events, pre-match receptions and matches included
- Changing contact data
- Adding partner events
- Access to QR Codes from your own INRUCK account
User : designates all persons, natural or legal, who can access the INRUCK Application.
Article 2: Access to the Application and Services
To access the Services, the User must download the INRUCK application from the “Google” and “Apple” stores.
For users with a User Account, upon first logging into the Application, you agree to these T&Cs and the Privacy Policy.
The INRUCK Application allows the User access to the following Services:
- Posting messages and photos;
The INRUCK app provides many ways to express yourself or communicate with your club's partner network and the club with the sharing of messages and photos.
Moderation may be applied to offensive, illegal or any other content that the club deems unsuitable for use on the application.
- Like and comment on posts;
It is possible to post a like or a comment under the publications present on INRUCK.

- Access to information from the club's partner companies;
With the partners' agreement, the INRUCK application can provide information regarding the partner's activities and contact methods.
- Access to contacts of the club's partner companies;
The user has the choice and the full right to share, or not, their own professional and/or personal information such as email address, telephone number, birthday, a website, an avatar as well as their position in the partner company.
- Access to club results and rankings;
The results and rankings of the teams present on the application are provided by a Score'n'co API, with their agreement.
- Access to the club's events calendar, including home matches;
The club authorizes WiiBus and the INRUCK application displayed the list of club events such as matches, pre-match receptions, business breakfasts or company visits and other services shared with partners and collaborators.
- Registration for club events, pre-match receptions and matches included;
Employees with a position in a partner company can register themselves or register their employees, clients, partners or any other person authorized to participate in an event. A single-use QRCode is associated with each registration. A unique code of several characters mixing numbers and letters is associated with each QRCode. The same QRCode must not be shared with several people, the club and the managers of the INRUCK application reserve the right to refuse access to a QRCode if the conditions are not respected and if the person is deemed hostile to the smooth running of the event.
- Changing contact data;
The individual has the option to modify their own contact information. By sharing their own data, they agree to the club's partners and collaborators having access to their data. The club, WiiBus and INRUCK cannot be held responsible for this data or its sharing because the user consents to communicate it.
- Adding partner events;
Partner administrators have the ability to add their own company events to the club's INRUCK calendar. They then agree to have the event shared with the club's INRUCK users and allow employees to register for it.
- Access to QR Codes from your own INRUCK account;
The administrator has the ability to distribute event QR Codes to their colleagues. These people are either direct users of the application or are external contacts. In the case of external contacts, the administrator can generate multiple QR Codes in their own INRUCK account. They can then share them in any way they wish with their external contacts (SMS, email, or any other application their phone may suggest). The club, WiiBus and INRUCK are not responsible for sharing QRCOdes and the responsibility lies entirely with the partner account administrator.
Forgotten User IDs
If the identifiers of a User Account are forgotten, the User must request a password reset from the INRUCK support service via the contact email address: cedric.ghironzi@wiibus.com
Account settings
The User has access to the information they have provided, such as their email address and company name. A logged-in User also has the option to upload a profile picture, enter their birthday, change their position, and modify the name entered.
If the User wishes to use the features related to the User Account, the User agrees to provide the information necessary to create the User Account. Regarding the Personal Data collected by WIIBUS, the User can refer to the Privacy Policy of the Application.
Any User with a User Account may unsubscribe at any time by contacting the support team at the following email address: contact@wiibus.frThis will be effective as soon as possible and in any case, within a maximum period of one month.
Breach
WIIBUS, the club and INRUCK may at any time and automatically suspend or delete a User Account, immediately and without further formality, in the event of a breach of these T&Cs. Once the User has been informed of the deletion of their Account, and within a reasonable time, the related Personal Data will be destroyed.
Article 3: Intellectual Property
Brands, logos and content
The brands, logos, signs and all contents of the Application (texts, images, sounds, etc.) are protected by intellectual property law and are the exclusive property of WIIBUS, the club, INRUCK and/or partners where applicable.
As such, the User undertakes, without this list being exhaustive, not to download, extract, store, use, reproduce, sell, communicate, represent, distribute and/or adapt the Application in whole or in part or one or more of its contents in whole or in part, directly or indirectly, on any medium whatsoever, by any means and in any form whatsoever, without express authorization from WIIBUS and/or its partners where applicable.
No license or other right to use any intellectual property right is granted to the User by simply posting content, trademarks and logos on the application.
Violation of these provisions subjects the User to the criminal and civil penalties provided for by the applicable legislation in this area.
Article 4: Liability and force majeure
The sources of information disseminated on the Application are deemed reliable but WIIBUS, the club and INRUCK do not guarantee that they are free from defects, errors or omissions, therefore, the responsibility of WIIBUS, of the club and of INRUCK will not be retained if this is the case.
The User acknowledges that, despite the high level of security standards implemented by WIIBUS, the club and INRUCK, data transmitted via the Internet does not pass through independent electronic communication networks with varying capacities and which are sometimes overloaded. The Internet is an open network and, consequently, information transmitted by this means is not protected against possible risks of misappropriation, fraudulent, malicious or unauthorized intrusion into the User's information system, hacking, unauthorized extraction or alteration of data, contamination by computer viruses, and it is the User's responsibility to take all appropriate measures to protect their information system against contamination by viruses or unauthorized intrusion attempts.
Any event resulting in a malfunction of the Application or interruption of the Services, particularly in the event of maintenance, shall in no way engage the liability of WIIBUS, of the club and of INRUCK. The User agrees not to hold against WIIBUS, to the club and to INRUCK of any interruption or suspension of the Services, even without notice.
The responsibility of WIIBUS, the club and INRUCK cannot be held liable in the event of force majeure or the actions of a third party.
The User is solely responsible for his or her browsing, particularly on the Application. In addition, the User agrees to comply with the following obligations:
- Carry out use of the Application in accordance with these T&Cs;
- Comply with all French, European and, where applicable, international laws and regulations when applicable;
- Not to infringe the rights of third parties and/or public order and morality;
- Do not undertake any activity that would disrupt or interfere with the operation of the Service, including servers and networks connected to the Service.
Article 5: External links
External links may be present on the Application in user posts and in company and contact files. The User is informed that by clicking on these links, he will exit the INRUCK Application.
INRUCK, WiiBus and the club have no control over the content of the web pages to which these links lead and cannot therefore, under any circumstances, be held responsible for this content.
Article 6: Applicable law and competent jurisdiction
These T&Cs are governed and interpreted in accordance with the provisions of French law. In the event of failure to resolve amicably a dispute arising between WIIBUS, the club or INRUCK and the User, the French courts will have sole jurisdiction.

The Parties, both having the status of trader in accordance with Article L. 212-1 of the French Commercial Code, agree to submit to the exclusive jurisdiction of the courts of Roman-sur-Isère (France).
